L-1 Visa

Types of L-1 Visas

L-1A Visa

L-1B Visa
This option is for employees with specialized knowledge that is essential to the company’s products, services, or operations. Specialized knowledge must be unique and critical to the organization’s success. L-1B visa holders can remain in the U.S. for up to five years.

Eligibility Requirements

  • The employee must have worked for the company abroad for at least one continuous year in the last three years.

  • The U.S. company must have a qualifying relationship with the foreign company, such as a parent, branch, affiliate, or subsidiary.

Application Process

The U.S. employer must file Form I-129, Petition for a Nonimmigrant Worker, with USCIS. Once the petition is approved, the employee applies for the L-1 visa at a U.S. consulate or embassy abroad.

New Office L-1s
If the U.S. office is newly established, the visa is typically approved for one year. During this period, the company must show that it is operating and that the employee is fulfilling their executive, managerial, or specialized knowledge role.
