EB-5 Green Card: Investor Visa

The EB-5 visa is an employment-based, fifth-preference immigrant category created to stimulate the U.S. economy through job creation and capital investment by foreign investors. It offers a direct pathway to lawful permanent residence for investors, their spouses, and unmarried children under 21.

Investment Requirements

Standard Investment
A minimum of $1,050,000 in a new commercial enterprise that will create at least ten full-time jobs for U.S. workers.

Targeted Employment Area (TEA)
If the investment is in a TEA — a rural area or an area with high unemployment — the minimum investment is reduced to $800,000.

Job Creation
The investment must create or preserve at least ten full-time jobs for qualifying U.S. workers within two years of the investor’s admission to the U.S. as a conditional permanent resident.

Regional Center Program

The EB-5 also offers the Regional Center option, which allows investors to pool funds in USCIS-designated regional centers. These centers focus on economic growth in targeted areas and may use indirect job creation to meet requirements.

Application Process

  • Form I-526: Filed to establish eligibility based on investment and job creation.

  • Conditional Green Card: Granted upon approval of I-526 and entry to the U.S. (or adjustment of status if already in the U.S.).

  • Form I-829: Filed two years later to remove conditions, proving that the investment has met job creation and other requirements.
