E Visa

The E visa category is a powerful option for entrepreneurs, investors, and business professionals from countries that maintain treaties of commerce and navigation with the United States. These visas allow qualified individuals to live and work in the U.S. to engage in substantial trade or to direct and develop enterprises in which they have invested. There are two main types: E-1 Treaty Trader and E-2 Treaty Investor visas.

E-1 Treaty Trader Visa

  • Purpose: For individuals engaged in substantial trade between the U.S. and their home country. Trade can include goods, services, or technology.

  • Requirements:

    • Must be a citizen of a treaty country.

    • Trade must be substantial and primarily between the U.S. and the treaty country.

    • The applicant must serve in an executive, supervisory, or essential skills role within the enterprise.

E-2 Treaty Investor Visa

  • Purpose: For individuals who are investing a substantial amount of capital in a U.S. business and will develop and direct its operations.

  • Requirements:

    • Must be a citizen of a treaty country.

    • Investment must be substantial and sufficient to ensure the success of the business.

    • The applicant must have the ability to direct and grow the enterprise.

Key Features of E Visas

  • No need for initial USCIS approval when applying abroad.

  • Filing for permanent residency does not automatically impact E visa eligibility.

  • More than 60 treaty countries currently qualify for E visa status.
