The R visa is a nonimmigrant visa for religious workers who wish to enter the United States temporarily to perform religious work. This visa helps religious organizations bring ministers, instructors, and other qualified workers to the U.S. to support their mission. At Abogada Vida, we guide both applicants and sponsoring organizations through every step of the process.
Who Qualifies for an R Visa?
- Must be a member of a religious denomination with a bona fide nonprofit religious organization in the United States.
- Must have been a member of that denomination for at least two years before filing.
- Must be coming to the U.S. to work part-time or full-time in a religious vocation, occupation, or as a minister.
Must work only for the sponsoring organization that filed the petition.
Types of Religious Work Covered
- Minister: Authorized clergy conducting worship services and performing other religious duties.
- Religious Vocation: Individuals such as nuns, monks, or brothers and sisters who have taken a lifelong religious commitment.
- Religious Occupation: Workers in positions with traditional religious functions, such as instructors, missionaries, or liturgical staff.
Application Process
- The U.S. religious organization files Form I-129, Petition for a Nonimmigrant Worker, with USCIS.
- Once approved, the worker applies for the R-1 visa at a U.S. embassy or consulate abroad.
- Upon entry, the worker is admitted in R-1 status to begin their religious duties.
Duration and Extensions
- Initial approval is for up to 30 months.
- Extensions may be granted for a total of up to five years.
- In some cases, further extensions may be available if an immigrant visa application is pending.
